Allahabad HC directs District Magistrate Mau to conduct a physical survey of the school

While hearing a bail petition of Mukhtar Ansari, Allahabad Court in the case of embezzlement of Vidhayak Nidhi, The court has directed the District Magistrate Mau, to conduct a physical survey of the school.

the Bench Comprising Single Bench of Justice Rahul Chaturvedi passed this order while hearing a Criminal Misc Bail Application filed by Mokhtar Ansari.

After hearing the arguments the Court directed the District Magistrate, Mau to have an on-spot physical survey of the school in question in the present case and have photographs, and file a detailed report containing:-

The Bail application was filed in the context of the matter and relates to the extension of “Vidhayak Nidhi” to some private school “Guru Jagdish Singh Baijnath Pehalwan Higher School Sarwan Mau” established by co-accused persons with the help and aid of ‘Vidhayak Nidhi’ extended by the applicant.

The court has made the following observations and made orders as follows:

“(I) Where is the school situated (i) who is the Principal and its Manager (ii) Up to which class the education is imparted (iii) Number of the registered students (iv) recognized education institution or not (v) Total number of the teaching staff (vi) Annual budget of the school & source of income (vii) Aided or unaided institution.

(II) This detailed information must be received to the Court from the District Magistrate, Mau in a sealed cover by the next date fixed.”

“The matter should be taken on the topmost priority by the District Magistrate, Mau and send the report in a sealed cover with above particulars and reply to query and photographs latest by 19th May 2022.

Both the parties have extended their specific arguments to their satisfaction At this juncture, Ratnendu Kumar Singh, AGA wants time to clarify certain factual/legal position of the case and for this purpose, he sought time.

Let the copy of the order be given to Ratnendu Kumar Singh, AGA for communication and compliance within the time specified”.

The matter will come up before the court again on May 20, 2022.
