In the case of Abhimanyu Singh v. Flipkart, a Lucknow court mandated on Monday that a First Information Report (FIR) be filed against the online retailer for allegedly selling a lawyer phony Apple Air Pods.
The Station House Officer (SHO), Police Station-Gomti Nagar Extension, Lucknow, was ordered by Chief Judicial Magistrate Ravi Kumar Gupta to file a police report (FIR) against the accused for defrauding and misleading the complainant. The court further ordered the police to properly investigate the associated cognizable offence.
In the current case, the complainant filed a request under Section 156(3) of the Code of Criminal Procedure asking for the filing of a FIR for the offence of cheating against Flipkart, its managing directors, Kalyan Krishnamurthy, as well as its sellers, Hydtel Retail Sales and Luminary Lifestyle Private Limited.
The complainant claimed that for the sum of Rs. 17,488, Flipkart had sold him a fake pair of Apple AirPods Pro (Bluetooth Headset).
